Blind Date Photoshoot Terms and Agreement This agreement outlines the terms and conditions for participation in the Blind Date Photoshoot experience ("the Service") provided by Appalachian Lens, hereafter referred to as "the Photographer." By paying the matching fee and completing the survey, you (the "Client") acknowledge and agree to the following terms and conditions. 1. Matching Fee and Payment 1.1 Matching Fee To participate in the Blind Date Photoshoot, the Client must pay a matching fee of $25. This fee is non-refundable once paid, even if the Client decides not to proceed with the photoshoot after being matched. 1.2 Photoshoot Date Fee Once the Client is matched with a partner, the total cost for the photoshoot date is $650. This fee covers the entire photoshoot experience, including all date-related expenses, planning, and execution. The cost of this fee may be split between the matched individuals, or the gentleman may pay the full amount with a $100 discount applied to the total. 1.3 Payment Schedule The $25 matching fee must be paid prior to the matching process. The $650 photoshoot date fee is to be collected within two weeks of being matched. Full payment of the photoshoot date fee must be completed before the photoshoot can be scheduled. 1.4 Payment Methods Payments can be made via all major debit and credit cards. All fees must be paid in full before proceeding with the matching process and scheduling of the photoshoot. 2. Client Enrollment in the "Dating Pool" 2.1 Survey Completion and Payment By completing the survey and submitting the payment, the Client is officially entered into the "dating pool" for potential matches. The Client will remain in the dating pool until they either find a match or request to be removed from the pool. 2.2 No Refund on Matching Fee The $25 matching fee is non-refundable. If the Client chooses not to proceed with a date after being matched, the matching fee will not be refunded. 3. Matching Process and Photoshoot Scheduling 3.1 Matching and Photoshoot Timing Once matched, the Client must be willing to schedule the photoshoot within one month of being paired with their match. The Photographer will work with both parties to select a mutually convenient date for the photoshoot. 3.2 Responsibility for Scheduling The Client is responsible for promptly scheduling the photoshoot with the Photographer after being matched. Delays in scheduling may result in rescheduling or cancellation at the discretion of the Photographer. 4. Photoshoot Expectations and Responsibilities 4.1 Comfort and Safety The Photographer strives to create a safe, comfortable, and enjoyable environment for all participants. If, at any point during the photoshoot, any individual feels uncomfortable, the session will be terminated immediately. 4.2 Photoshoot Date Fees The $650 photoshoot fee covers the full cost of the date and photoshoot, including all planned activities and the photoshoot session itself. The Clients are expected to show up for the scheduled date, relaxed and ready to enjoy the experience. 4.3 Photographer's Role The Photographer is responsible for all aspects of the date planning, including selecting the location, activities, and photo shoot ideas. The Photographer will create a fun, engaging atmosphere to help both participants feel at ease. 5. Delivery of Photos 5.1 Photo Deliverables Both Clients will receive a minimum of 20 professionally edited photos within two weeks of the photoshoot, delivered via a password-protected online gallery. The Photographer will choose the best images from the session to ensure a variety of shots. 5.2 Use of Photos The Client may only use the photos for personal use unless otherwise agreed upon in writing. This includes sharing photos on personal social media profiles, but not for any commercial purposes, advertisements, or promotions. 6. Copyright and Usage Rights 6.1 Photographer’s Retention of Copyright The Photographer retains full copyright over all images captured during the photoshoot. The Client agrees not to alter, crop, or edit the images without the Photographer’s permission. 6.2 Photographer’s Use of Photos The Photographer retains the right to use any images captured during the photoshoot for promotional purposes, including on the Photographer’s website, blog, social media accounts, and in other advertising materials, unless the Client specifically requests, in writing, that the photos not be used. 7. Liability and Disclaimers 7.1 No Responsibility for Match Outcomes The Photographer is not responsible for any personal or emotional outcomes of the date. While the Photographer strives to make the best possible match, there is no guarantee that the Client will connect romantically with their match, or that the date will be successful. 7.2 Photographer’s Liability The Photographer is not liable for any damages, losses, or injuries that occur during the photoshoot or date. The Client agrees to hold the Photographer harmless for any incidents that may occur during the event. 7.3 Force Majeure In the event of unforeseen circumstances, including but not limited to weather conditions, emergencies, or events beyond the Photographer’s control, the photoshoot may be rescheduled. The Photographer will provide as much notice as possible and make efforts to accommodate both parties. 8. Cancellations and Rescheduling 8.1 Cancellations by the Client (After Date Fee is Paid) If the Client cancels after the $650 photoshoot date fee has been paid and the photoshoot has been scheduled, the fee is non-refundable. This is due to the time and resources the Photographer has already invested in planning and preparing for the photoshoot and the date experience. 8.2 Rescheduling Option If the Client wishes to reschedule the photoshoot, the Client must notify the Photographer at least 3 days prior to the scheduled photoshoot date. If the Client reschedules within this timeframe, the photoshoot will be rescheduled at a mutually convenient time, subject to availability. If the Client does not notify the Photographer within the 3-day period, the full photoshoot fee is forfeited. 8.3 Cancellations by the Photographer In the event that the Photographer needs to cancel or reschedule the photoshoot, the Client will be notified as soon as possible. Any payments made for the photoshoot will be refunded, and alternative scheduling options will be offered. 9. Miscellaneous 9.1 Agreement Modifications The Photographer reserves the right to update or modify this agreement at any time. Clients will be notified of any changes, and the updated terms will be binding upon their next use of the service. 9.2 Legal Compliance This agreement shall be governed by and construed in accordance with the laws of the state of Tennessee, United States. Any disputes arising from this agreement shall be resolved through arbitration or in the courts located in Decatur, Tennessee. 9.3 Client's Conduct During the Photoshoot The Client agrees to behave respectfully and professionally during the photoshoot. Any inappropriate or disruptive behavior will result in immediate termination of the photoshoot, and no refunds will be given. 9.4 Location and Travel Expenses The $650 photoshoot date fee covers the location, travel, and other fees associated with the photoshoot within 65 miles of Decatur, Tennessee, 37322. For locations further than this radius, additional travel fees may apply, which will be discussed and agreed upon before scheduling. 9.5 Photography Equipment Handling The Photographer retains full control over the photography equipment during the photoshoot. The Client is not permitted to handle or operate the Photographer’s equipment without permission. 9.6 Indemnification The Client agrees to indemnify, defend, and hold harmless the Photographer from and against any and all claims, losses, damages, liabilities, or expenses arising out of or in connection with their participation in the photoshoot or the use of the resulting images, except to the extent caused by the Photographer’s gross negligence or willful misconduct. 9.7 Confidentiality The Photographer will maintain the confidentiality of all personal information shared by the Client during the matching process and photoshoot planning. This information will not be shared with third parties except as necessary for the execution of the photoshoot or as required by law. 9.8 Exclusivity The Client agrees that the Photographer is the exclusive provider of all photoshoot and date planning services. No other photographers or videographers will be permitted to participate in the session without the Photographer’s prior written consent.
